The service, software, and Website are collectively referred to as the "Service."
This Privacy Policy applies to information that you provide to us through the Service and to video and related data processed through the Service. We may update this Privacy Policy from time to time and will notify you of material changes by posting the revised policy on the Website and updating the "Last updated" date above. Prior versions will be archived and made available on request. Your continued use of the Service is subject to the then-current Privacy Policy.
Information We Collect
The data we regularly collect about visitors to the Website (e.g., IP address, browser type, pages accessed, duration of visit) does not necessarily identify you personally, and that is not our intention. We collect personally identifiable information about you — such as your name, email address, and, where you choose to receive text messages from us, your mobile phone number — when you voluntarily provide it by registering or using the Service. Once you become a user, you may provide additional information; doing so is optional.
To facilitate your use of the Service, we may automatically collect certain information when you access or use the Service, including through cookies and similar technologies (see "Cookies and Tracking Technologies").
Video and Analytics Data
Because GuardVue provides cloud video monitoring and analytics, the Service collects, transmits, stores, and processes video and image data and related metadata (such as timestamps, camera location, and event/alert records) on behalf of our customers. GuardVue [does / does not] use facial recognition or other biometric identification or analytics. Where biometric data is processed, we do so only with the consent required by applicable law. Customers who deploy our cameras are responsible for providing any notices and obtaining any consents required by law in the areas they monitor.
Audio Recording
Audio recording is disabled by default. A customer may choose to enable audio capture on supported devices. When enabled, GuardVue cameras capture ambient audio on an omnidirectional basis to provide environmental context alongside video; this audio is not directed at, focused on, or intended to capture specific conversations or particular areas. Cameras are typically deployed on private property in outdoor or exterior locations. Nevertheless, ambient recording may capture sounds and speech that occur within range of a device, including from visitors, workers, or other individuals present on the property. When enabled, audio is processed and retained as part of the associated video recording.
Recording audio is subject to additional legal requirements that vary by jurisdiction, and in some areas the consent of the people being recorded is required, even on private property and even in outdoor areas. Customers who choose to enable audio recording are solely responsible for determining whether it is permitted in their location and for providing any notices and obtaining any consents required by applicable law.
Use of Information
We use your personally identifiable information primarily to: (i) provide and improve our Service, features, and content; (ii) administer the Service, including verifying your authority to access it; (iii) provide customer support; (iv) fulfill your requests; (v) personalize your experience; (vi) provide software updates and product announcements; and (vii) send you information from us, including, where you have opted in, text (SMS) messages related to the Service.
You may opt out of non-service-related communications by updating your profile, following the unsubscribe instructions in any communication, or — for text messages — by replying STOP. We also use information obtained by technical means to monitor and analyze use of the Service, administer it, improve its functionality, and tailor it to your needs.
SMS / Text Messaging
If you opt in to receive text messages from GuardVue, message and data rates may apply and message frequency varies. You can opt out at any time by replying STOP, or reply HELP for assistance.
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. All categories of sharing described in this Privacy Policy exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.
We will not sell, share, or rent your SMS opt-in information to any third party for any reason other than to deliver the specific services associated with the messaging campaign you signed up for. Because text messaging requires your explicit, one-to-one consent, your data as it relates to SMS messaging will not be shared with any non-affiliated third party. We may, however, share your personal data — including your SMS opt-in or consent status — with third parties that assist us in delivering messaging services, such as messaging platform providers, phone carriers, and other vendors directly involved in delivering text messages to you.
Email Communications
Where we send commercial electronic messages by email, we do so in accordance with applicable anti-spam laws, including Canada's Anti-Spam Legislation (CASL). We send such messages only with the required consent, identify ourselves clearly, and include a working unsubscribe mechanism that we honor promptly.
How We Share Information
GuardVue does not sell, rent, or share your personally identifiable information with third parties for their own marketing purposes. We disclose personal information only in the following circumstances:
- Service providers and sub-processors. We use third parties who help us provide and maintain the Service (including cloud hosting and data storage, maintenance, database management, web and video analytics, payment processing, and messaging delivery). They are bound by contract to use information only to perform services for us and to protect it appropriately. A current list of categories of sub-processors is available on request.
- Legal and safety. We may disclose information where reasonably necessary to comply with applicable law, regulation, legal process, or governmental request (see "Law Enforcement and Legal Requests"); to enforce our terms; or to protect the rights, property, or safety of GuardVue, our users, or the public.
- With your direction. As part of the Service, we make your content available to other users with your consent.
- Business transfers. We may disclose information in connection with a merger, acquisition, financing, or sale or transfer of all or part of our business or assets, subject to the recipient honoring this Privacy Policy.
You should be aware that information you voluntarily disclose in any chat rooms, forums, message boards, profiles, or other public features can be collected and used by others and is beyond our control. Please do not post personal information you expect to keep private.
Our Role: Controller and Processor
For information about your GuardVue account (such as your name, email, and billing details), GuardVue acts as the controller responsible for that data. For video, audio, and related data that our business customers record and manage using the Service, GuardVue generally acts as a processor (service provider) acting on the customer's behalf and under their instructions. In that case, the deploying customer is the controller responsible for providing notices, establishing a lawful basis, and responding to the rights requests of individuals captured by their cameras. If you are an individual recorded by a GuardVue camera operated by one of our customers, please direct privacy requests to that customer; we will assist them as required by law.
Law Enforcement and Legal Requests
We may receive requests from law enforcement or other authorities for video footage or other data. We disclose such data only where we have a good-faith belief that disclosure is required by valid legal process (such as a warrant, subpoena, court order, or other lawful demand) or is otherwise permitted or required by law. Where we are legally permitted to do so, we will notify the affected customer before disclosing data they control, so that they may exercise any available rights. We will narrow disclosures to what the request reasonably requires.
Cookies and Tracking Technologies
We use cookies and similar technologies to operate the Website, remember your preferences, analyze usage, and improve the Service. We currently use [e.g., Google Analytics — list your tools]. You can control cookies through your browser settings; restricting cookies may limit some features. Where required by law, we will obtain your consent before placing non-essential cookies. Aggregated and De-identified Data

The Service uses analytics that may automatically detect events and generate alerts, and we may derive insights about usage patterns. We do not make decisions that produce legal or similarly significant effects about you based solely on automated processing without a lawful basis. Where applicable law grants you rights regarding automated decision-making or profiling, you may exercise them as described in "Your Privacy Rights."
Data Retention and Deletion
We retain personal information for as long as needed to provide the Service, comply with our legal obligations, resolve disputes, and enforce our agreements. Your Privacy Rights

We will respond as required by applicable law and will not discriminate against you for exercising your rights. If GuardVue acts as a processor for a customer's video data, we will refer your request to the responsible customer.
- Canada (PIPEDA / Alberta PIPA / British Columbia PIPA). You may request access to and correction of your personal information and may withdraw consent (subject to legal or contractual restrictions). If you have an unresolved concern, you may contact the Office of the Privacy Commissioner of Canada or your provincial commissioner.
- California (CCPA/CPRA). California residents may request to know the categories and specific pieces of personal information we collect, the sources and purposes, and the categories of third parties to whom it is disclosed; request deletion or correction; and opt out of the "sale" or "sharing" of personal information. GuardVue does not sell or share personal information as those terms are defined under California law. Where we process "sensitive personal information" (which may include precise geolocation or biometric information), you may request that we limit its use to permitted purposes.
- European Economic Area / United Kingdom (GDPR / UK GDPR). You may have rights of access, rectification, erasure, restriction, portability, and objection, including regarding automated decision-making, and the right to lodge a complaint with a supervisory authority. We process personal data on the lawful bases of performance of a contract, your consent, our legitimate interests, and compliance with legal obligations. Individuals Recorded on Camera
If you are not a GuardVue account holder but believe you have been recorded by a GuardVue camera, the customer who operates that camera is generally responsible for your data. You may contact us at info@GuardVue.net and we will, to the extent we are able, direct your request to the responsible customer and assist them in responding as required by law.
International Transfers
The Website and Service are hosted in [United States / Canada]. If you access the Service from another region, your personal data may be transferred to and processed in [hosting country], which may not provide the same level of data protection as your home jurisdiction.
